Dean Weingarten has a good find at Ammoland. Judge Eduardo Ramos, the U.S. District Judge for the Southern District of New York,  has issued an Opinion & Order that a ban on stun guns is constitutional. A New York State law prohibits the private possession of stun guns and tasers; a New York City law prohibits the possession and selling of stun guns. Judge Ramos has ruled these laws do not infringe on rights protected by the Second Amendment of the United States Constitution. Let's briefly…… [read more]

Training the Afghan National Army?

For Lieutenant Ed Maloney, the most difficult part of leading a four-day mission in eastern Afghanistan was persuading Afghan soldiers to leave their base in the first place.

It took three hours of negotiations on the night before departure to convince the Afghans the expedition to Sherzad district in Nangarhar province was worthwhile.

“Their predecessors had a tough time in this district, and these soldiers thought it was unnecessary and too risky,” Maloney said.

“Of course we can’t order them to do things, but we told them it was exactly the sort of security mission they needed to do and which should impress their bosses.”

Let’s leave behind the issue of tactical capabilities, corruption, drug use, officer entitlement and all of the other bad traits we have seen in the ANA.  Force projection and assessment of atmospherics are the most important aspects of counterinsurgency.  In the absence of U.S. forces to persuade them to work at the right things, with the ANA sitting on their FOBs afraid to go on patrol, the Taliban have nothing to fear.

The issues go well beyond knowing how to do what they are supposed to be doing.  The root of the problem is that they don’t even understand what they are supposed to be doing and why they are supposed to be doing it.

Former Guantanamo Prisoner Commanding Southern Taliban Military

A man who was freed from Guantanamo after he claimed he only wanted to go home and help his family is now a senior commander running Taliban resistance to the U.S.-led offensive in southern Afghanistan, two senior Afghan intelligence officials say.

Abdul Qayyum is also seen as a leading candidate to be the next No. 2 in the Afghan Taliban hierarchy, said the officials, interviewed last week by The Associated Press.

Qayyum’s key aid in plotting attacks on Afghan and international forces is another former Guantanamo prisoner, said the Afghan intelligence officials as well as a former Helmand governor, Sher Mohammed Akundzada. Abdul Rauf, who told his U.S. interrogators that he had only loose connections to the Taliban, spent time in an Afghan jail before being freed last year.

He rejoined the Taliban, they said. Akundzada said he warned the authorities against releasing both him and Qayyum.

Like Qayyum, Rauf is from Helmand province in southern Afghanistan. During the Taliban’s rule, which ended in 2001, Rauf was a corps commander in the western province of Herat and in the Afghan capital, Kabul, said Akhundzada.

The intelligence officials were interviewed in Helmand, where the Taliban control several districts, and spoke on condition of anonymity lest they attract the militia’s attention.

They said Qayyum was given charge of the military campaign in the south about 14 months ago, soon after his release from the Afghan jail to which he had been transferred from Guantanamo. That includes managing the battle for the town of Marjah, where NATO troops are flushing out remaining militants.

Qayyum, whose Taliban nom de guerre is Qayyum Zakir, is thought to be running operations from the Pakistani border city of Quetta. A Pakistani newspaper report that he was recently arrested was denied by Abdul Razik, a former governor of Kajaki, Qayyum’s home district, which is under extensive Taliban control.

One of the intelligence officials also questioned the report. He said a house Qayyum was in was raided about two weeks ago and three assistants were arrested but he escaped. A week ago he was seen in Pishin, a Pakistani border town about 50 kilometers (30 miles) from Quetta, the official said.

“He’s smart and he is brutal,” said Abdul Razik. “He will withdraw his soldiers to fight another day,” he said, referring to the Marjah campaign.

Qayyum, who is about 36 years old, is close to the Taliban’s spiritual leader, Mullah Mohammed Omar. He has been tipped as a candidate to replace the militia’s second-in-command, Mullah Abdul Ghani Baradar, who was among several Taliban leaders arrested recently in Pakistan.

So much for the notion of harmless, innocuous prisoners at Guantanamo.  Also, so much for the silly notion that in arresting Mullah Baradar the Pakistanis and CIA took out one of the prime prospects for reconciliation – as if the Quetta Shura would ever reconcile anyway.  If Baradar was so anxious to reconcile, had the approval of Mullah Omar, and had the ear of the Karzai government, then replacing him with a hard core, brutal commander would be inconsistent and illogical.

The serious Taliban will not reconcile, and Guantanamo wasn’t such a bad idea after all, was it?  As it turns out, Guantanamo has some very bad actors, and releasing them is a worse idea than having a potential recruiting ploy for the enemy.  Pity – such a quick, bleak and remarkable end to what was from the beginning very misguided strategic ideas.

Intelligence Ambiguity in Iraq

The mood is tense in the Anbar Province, but more to the point, there is general intelligence ambiguity in Iraq.

U.S. commanders say they are unsure about who is responsible for the persistent violence in Iraq, underscoring the challenge they face trying to keep a lid on it amid parliamentary elections this weekend.

While security has improved significantly across Iraq in recent years, in the weeks leading up to the March 7 vote, U.S. commanders have reported an increase in low-level violence: kidnappings, assassinations, and mortar attacks against Baghdad’s heavily fortified Green Zone, the seat of government power.

And since August, a series of large-scale bombings aimed at government buildings have ripped through Baghdad, killing several hundred people and shaking confidence in Prime Minister Nouri al-Maliki’s security services, following the withdrawal of most U.S. combat forces from major Iraqi cities last summer.

Commanders worry the violence could spike further after the election if parties feel there was fraud or if negotiations to form a government after the vote break down.

U.S. and Iraqi successes cracking down on organized insurgent groups have caused the groups to splinter into an ill-defined web of smaller, often independent, groups with widely divergent motives, ranging from the ideological to the purely material, according to American military officials.

“There is definitely less clarity as to who the enemy is,” says a U.S. Special Forces officer in Baghdad. “The big-time players aren’t there anymore. The organized terrorists aren’t there anymore.”

Iraqi officials are blaming al Qaeda-linked terrorists and loyalists to Saddam Hussein’s Baath Party for the attacks. Iraq officials said Tuesday the number of Iraqis killed in February was twice as high as in January and 40% higher than a year earlier.

But U.S. military officers, working in Baghdad and Anbar provinces, say the real picture is less clear, making effective countermeasures more difficult.

“Whether or not the violence is extremist, political or tribal is not clear at this point,” says U.S. Army Brig. Gen. Kevin Mangum, the deputy commanding general of U.S. forces in Baghdad and Anbar. “We’re not being evasive; it’s just really hard to figure out.”

Of course the situation is hard to figure out.  It’s no wonder that the U.S. Marines are now gone from the Anbar Province.  The Status of Forces Agreement tied their hands to the point that they were required to give the Iraqis 72 hours notice prior to troop movements outside of their bases, and then only with Iraqi escort.  According to one honest Iraqi Colonel, “They are now more passive than before,” he said of U.S. troops. “I also feel that the Americans soldiers are frustrated because they used to have many patrols, but now they cannot. Now, the American soldiers are in prison-like bases as if they are under house-arrest.”

When no patrols can be conducted and no force projected, the atmospherics of the population cannot be assessed.  There is no way to perform counterinsurgency under these conditions, and the best hope is that a political solution can be worked out between sects and political parties.  Based on what has been demonstrated to date, this may be a forlorn hope in the short term.

Marine Corps Commandant on DADT and Expeditionary Warfare

Marine Corps Commandant Conway opposes the repeal of Don’t Ask Don’t Tell (DADT).  Spencer Ackerman weighs in with the point that “Conway is implicitly assuming that the interests of the Corps and the interests of gays and lesbians are two different things. But there are, in fact, gay Marines.”

Later, he makes the following observations:

It’s his right. But if he opposes repeal, it’s curious that he doesn’t evidently explain why open gay service is bad for military readiness. (I am having a hard time finding the hearing transcript, but none of the reports I’ve seen indicate that Conway offered an argument for repeal’s negative impact on core military capabilities.) The U.S. military would be unique amongst the 20-odd militaries that have embraced open gay service over the past 25 years if somehow combat readiness declined as a result. I have every confidence, thanks to the gay servicemembers I know and have been lucky enough to befriend, that what gay Marines want is to do their jobs without fear of persecution or discharge on the basis of their identity. They’ll want to send the same ribald messages to their intended hook-ups and jump-offs through social-networking sites that straight soldiers, sailors, airmen and Marines get to send during downtime. And when it’s time for them to do their jobs, they’ll do their jobs. Period. Because they want to be Marines, and if they’ve made it into combat situations, they’ve earned it.

Well, the U.S. Marine Corps isn’t like 20 other militaries on earth.  They are the best.  But aside from false comparisons, I don’t believe that Spencer fundamentally understands where Conway is coming from.  The Corps operates as a very base and basic level.  It has no interest whatsoever in fomenting societal change of any sort.  Its interests intersect nowhere and with no one, save that of the security of the U.S.  The Marine Corps cares about no one and nothing except the Marine Corps.

The Marine Corps needs no one.  They have met their recruiting goal every year, and when the mandate to increase the size of the services came down, the Corps met their goals before the Army.  Large reenlistment bonuses shrank to nothing after having been implemented a few short months because the Corps became bloated with NCOs.  Everyone wanted to reenlist.

For Commandant Conway to favor repeal of DADT, someone would have to explain to him why this policy change would be in the interests of the Corps, not gays or lesbians, or societal harmony, or societal change, or anything else of the sort.

In order properly to understand DADT and any change to it, we must first of all jettison personal feelings concerning the subject, but (and this is important) we must also throw the Red Herring back into the sea, or burn the straw man, or betray the canard, depending upon your choice.

Recalling what I previously said concerning DADT:

It doesn’t prevent gays from serving in the military.  That’s just a mythical talking point of those who advocate its revocation.  DADT only prevents open discussion or practice of such things.  It is, by the way, similar to the way heterosexual relations are treated as well.  Men stay away from women altogether in uniform.  It isn’t practiced, it isn’t discussed, it is frowned upon – in theory.  This isn’t to say that it doesn’t happen, any more than DADT would imply that gay sexual relations don’t happen.  It does mean that there are certain requirements in the military that comport with good discipline, and they are enforced to the extent possible.  For a branch like the Marines which has as their cornerstone removing differences and enforcing sameness (or at least relegating them to unimportant status – e.g., no one can remove language barriers), it probably will have a significant affect.

Now for my own views.  I thought about this position within the context of the only exception that I can think of, namely, marriage.  Men and women are allowed to be married in the military.  But marriage is not performed by the Marine Corps or Army.  It is performed and recognized within and by states which have laws that govern such things.  Imposing homosexual marriage on a branch of the service just to say that there is no exception to the way gays and heterosexuals are treated under DADT is a false dilemma.  It is imposing a foreign problem on the military – a consideration that should be irrelevant to the conversation.

In a republic such as ours, laws are changed by legislative process which usually begins with advocacy.  One group or another wants a law changed or enacted, and that group presses the issue.  If gays want to marry, changing DADT isn’t the way to go.  Changing laws is the way to go.  No gay marriage (insofar as DADT applies) in the military (similar to no gay marriage in most states)  is an output (or outcome) of the debate, not an input to it.

No one has to hide or lie.  Gays can still serve, but they must follow the same rules as everyone else.  Don’t fraternize.  Period.  End of discussion.

Spencer goes on with Conway’s testimony to outline troubling statements concerning his focus on expeditionary warfare.

Other elements of Conway’s testimony have fulsome praise for the Marine Corps’ history of involvement in counterinsurgency, so I don’t wish to caricature what he’s saying. And I make no argument against the need for amphibious assault capabilities. As Conway says very well, the “littoral domain … where the land and sea meet [is]… where most of the world lives.” But if Afghanistan (a mission that will continue for years) and Iraq (a mission that the Marines have pretty much entirely concluded) are most likely models of future combat, then it raises the question whether the Corps’ “designed missions” ought to look more like the “assigned missions.” It’s a balance, and I get that, and perhaps Conway doesn’t share the view that hybrid and land-intensive close fights are the near-term future of combat. But he suggests in his testimony that he does (“The current transnational struggle against violent extremism will not end anytime soon…”) and if so, then the question about designed-mission priorities returns.

Spencer’s comments are well taken, and Conway’s focus on expeditionary warfare are well rehearsed over this site.  My objections to Conway’s views have always come at a very fundamental level.  When Marines were losing their legs in Now Zad and we had Battalions of Marine Infantry on board Amphibious Assault Docks, I complained loudly.

I do not now and have never advocated that the Marine Corps jettison completely their notion of littoral readiness and expeditionary warfare capabilities, but I have strongly advocated more support for the missions we have at hand.

Finally, it occurs to me that the debate is unnecessary.  While Conway has famously said that the Corps is getting too heavy, his program relies on the extremely heavy Expeditionary Fighting Vehicle, that behemoth that is being designed and tested because we want forcible entry capabilities – against who, I frankly don’t know.

If it is a failing state or near failing state, no one needs the capabilities of the EFV.  If it is a legitimate near peer enemy or second world state, then the casualties sustained from an actual land invasion would be enormous.  Giving the enemy a chance to mine a beach, build bunkers, arm its army with missiles, and deploy air power, an infantry battalion would be dead within minutes.  1000 Marines – dead, along with the sinking of an Amphibious Assault Dock and its associated EFVs.

No one has yet given me a legitimate enemy who needs to be attacked by an EFV.  On the other hand, I have strongly recommended the retooling of the expeditionary concept to rely much more heavily on air power and the air-ground task force concept.  It would save money, create a lighter and more mobile Marine Corps (with Amphibious Assault Docks ferrying around more helicopters rather than LCACs), and better enable the Marines to perform multiple missions.  I have also recommended an entirely new generation of Marine Corps helicopters.  There is more than one way to skin a cat, and forcible entry can be effected in many ways.

There are more logistical problems in the Khyber region, just as I predicted two years ago.

Suspected Islamist militants armed with guns and rockets on Monday blew up a tanker carrying fuel through Pakistan for NATO troops based in neighbouring Afghanistan, police said.

Several armed men lobbed a rocket and then opened fire on the supply convoy on the outskirts of Pakistan’s northwestern city Peshawar, senior police officer Imtiaz Ahmed said.

“The attack triggered a huge fire and destroyed one tanker. Its driver escaped unhurt but his helper was wounded,” he said.

In a subsequent exchange of fire lasting up to an hour, Pakistani security forces killed a militant, another police officer Karim Khan said.

Police did not immediately identify the assailants, but the Taliban and members of local militant group Lashkar-e-Islam regularly attack NATO supply vehicles on the main route through northwest Pakistan.

Lashkar-e-Islam is active in the lawless region of Khyber, which is just outside Peshawar and part of Pakistan’s tribal belt snaking along the Afghan border that Washington has branded the headquarters of Al-Qaeda leaders.

About 80 percent of supplies destined for the 121,000 US and NATO troops in landlocked Afghanistan pass through Pakistan.

Are we making any progress on engagement of the Caucasus?

President Mikheil Saakashvili recently offered Georgia as a logistical hub for NATO’s operations in Afghanistan. This offer, made in an interview with The Associated Press, came only days after NATO had finalised a supply route agreement with Kazakhstan in the wake of NATO’s expanding mission in Afghanistan. While a supply route through Georgia already functions (for equipment, not armaments), U.S. officials have not immediately accepted Saakashvili’s new proposal. Russia might be in the way, analysts say.

Saakashvili offered Georgia’s Black Sea ports of Poti and Batumi as docks for military supply ships and the country’s airports as refuelling points for cargo planes. AP quoted Pentagon officials as saying that the U.S. Defense Department was aware of Saakashvili’s offer, but had not explored the proposal.

The U.S. Special Representative for Afghanistan and Pakistan, Ambassador Richard Holbrooke, has scheduled a visit to Georgia on February 21-22. He plans to meet Saakashvili and visit Georgian troops at the Krtsanisi National Training Centre and observe their training for the operation in Afghanistan. Reportedly, the issue of Georgia as a supply route for the war could also be on the table.

Georgia has already been utilised as a transit point for shipment of non-armaments. “The route to Afghanistan is already used extensively, because almost 80 percent of cargo which is not going through Pakistan is going through Georgia, and only 20 percent through Russia, already,” said Alexander Rondeli, President of GFSIS (the Georgian Foundation for Security in International Studies).

Ariel Cohen, Senior Research Fellow at the Heritage Foundation, said that the supply route to Afghanistan via Eurasia has been in existence since 2001. “I do not think this [Saakashvili’s offer] is something particularly remarkable because the U.S. is covering all the bases. It is shipping equipment, both lethal and non-lethal, via Russia and Kazakhstan, as well as via Georgia and Azerbaijan across the Caspian Sea to Central Asia.

Oh good heavens – commit already.  To say that 80% of logistics that don’t flow through Pakistan already flow through the Caucasus is to say nothing.  Ninety percent of our logistics flow through Pakistan.  To say that Russia stands in the way is to reiterate what we all already know, i.e., that there are dangerous dictators who desire regional hegemony.  It is to say nothing.  Senior Research Fellow at the Heritage Foundation is a nice title for a man who needs to do better analysis work.  The U.S. has not covered all of the logistical bases when we are reliant on Karachi, Chaman and Khyber to supply our troops in Afghanistan.

There are attempts at better logistics, but this work bottlenecks in Khyber.  It’s still not too late to engage the Caucasus (including Georgia) like I recommended one year ago.

The Media, the New Media and U.S. Intelligence

The DoD policy on the new media has been released.  There are positive steps – computers are to be configured to access such sites within the constraints of operational security.  But the policy is subject to local application and enforcement.  Milblogging.com likes it, but I’ll wait to see the affects of the policy before weighing in on it.

My experience with blogging is that even as a parent of a member of the military, my words got significant attention to both me and my son, some of it unwanted and unwarranted.  There were daily site visits from PAOs, and usually within minutes of making posts.  If I mentioned water survival training while donning body armor, it got my son a visit to the First Sergeant’s office and a call from the Colonel, or better yet, a comment about how “we don’t do that sort of thing.”

Absurd.  Nothing false, nothing OPSEC about it, just a desire to control the narrative.  Concern over what mothers might think if they read the blog, or something of that nature.  I would have thought it wise and laudable that the Marines taught their guys to deal with HMMWV rollover incidents where the Marine ended up in a river with his body armor on.  After all, it had happened before.

The secrecy surrounding the 26th MEU was extraordinary.  We got more information from his deployment to Fallujah than we did from the Persian Gulf.  But any bystander at the Suez Canal who has a cell phone can inform his contacts when he sees a U.S. Amphibious Assault Dock floating by.  The concern that a Marine on board a ship  informing his family members about his proximity being more valuable information than someone in Egypt actually seeing a ship floating by is the fantasy of control freaks.  Enlisted men rarely are in possession of something that can seriously compromise OPSEC, and if they are, they are usually mature enough to handle the responsibility.

Stepping into the twenty first century is proving to be difficult for the military in more ways than accepting social networking.  In Systemic Defense Intelligence Failures, I lamented the fact that I had pointed out the Taliban strategy of targeting lines of logistics two years ago, while Army intelligence was busy denying that there would be any resurgence of the Taliban or even a spring offensive in 2008.  Military intelligence should have been reading my analysis rather than arguing their own merits.  Intelligence failures also played a part in the losses at COP Keating and Wanat.

The DoD may be adjusting.

On their first day of class in Afghanistan, the new U.S. intelligence analysts were given a homework assignment.

First read a six-page classified military intelligence report about the situation in Spin Boldak, a key border town and smuggling route in southern Afghanistan. Then read a 7,500-word article in Harper’s magazine, also about Spin Boldak and the exploits of its powerful Afghan border police commander.

The conclusion they were expected to draw: The important information would be found in the magazine story. The scores of spies and analysts producing reams of secret documents were not cutting it.

“They need help,” Capt. Matt Pottinger, a military intelligence officer, told the class. “And that’s what you’re going to be doing.”

The class that began Friday in plywood hut B-8 on a military base in Kabul marked a first step in what U.S. commanders envision as a major transformation in how intelligence is gathered and used in the war against the Taliban.

Not too many months ago Maj. Gen. Michael T. Flynn published a scathing critique of intelligence analysis in Afghanistan (I thought it was more than a little weird and a bit too political to publish this report with CNAS).  But I have read the entire report by Matthieu Aikins in Harpers.  It’s well worth the read by people interested in hard core data, names, information and analysis of the situation in Afghanistan.

Whether studying Aikins’ report, or Nicholas Schmidle on the Next-Gen Taliban, or David Rohde’s account of his captivity under the Taliban, some of the best information and analysis is right in front of our eyes if we can think outside the box.  This is why the media must be culled for good reports, and – to a lesser extent – it’s why I get military visits every day.  The new media merits its own attention, but it needs to be the right kind of attention.  We need for the military to pursue good analysis, not fulfill their own [sometimes] megalomaniacal ambitions to control every little detail of everyone’s life.

Half of Quetta Shura Arrested

Pakistan has supported a robust U.S. drone campaign against the Pakistan Taliban, or Tehrik-i-Taliban, because they see them at least somewhat as an existential threat.  The Afghan Taliban led by Mullah Omar is a different story.  The leadership is primarily in Pakistan, at first in Quetta and eventually scattered as necessary to avoid detection.  There has been no drone campaign against them because the Pakistani leadership and Army has a quaint but wrongheaded notion of using them (throughout Afghanistan and Kashmir) as a counterbalance against what they view as Indian hegemony.  That is, until recently.

Their top military commander, Mullah Abdul Ghani Baradar, was recently captured in the port city of Karachi.  There is a bit of intrigue surrounding his capture, including the highly plausible hypothesis that Pakistan wants a place at the bargaining table if and when the Taliban ask for negotiations.  Whatever the reason(s), they are still salient, as half of the Quetta Shura has now been arrested in Pakistan.

Pakistan has arrested nearly half of the Afghanistan Taliban’s leadership in recent days, Pakistani officials told the Monitor Wednesday, dealing what could be a crucial blow to the insurgent movement.

In total, seven of the insurgent group’s 15-member leadership council, thought to be based in Quetta, Pakistan, including the head of military operations, have been apprehended in the past week, according to Pakistani intelligence officials.

Western and Pakistani media had previously reported the arrest of three of the 15, but this is the first confirmation of the wider scale of the Pakistan crackdown on the Taliban leadership, something the US has sought.

“This really hurts the Taliban in the short run,” says Wahid Muzjda, a former Taliban official turned political analyst, based in Kabul. Whether it will have an effect in the long run will depend on what kind of new leaders take the reins, he says.

News of the sweep emerged over the past week, with reports that Pakistani authorities had netted Mullah Abdul Ghani Baradar, the movement’s second in command, as well as Maulavi Abdul Kabir, a prominent commander in charge of insurgent operations in eastern Afghanistan, and Mullah Muhammad Younis.

Pakistan has also captured several other Afghan members of the leadership council, called the Quetta Shura, two officials with the Pakistani Intelligence Bureau, and a United Nations official in Kabul told the Monitor.

These include: Mullah Abdul Qayoum Zakir, who oversees the movement’s military affairs, Mullah Muhammad Hassan, Mullah Ahmed Jan Akhunzada, and Mullah Abdul Raouf.

At least two Taliban shadow provincial governors, who are part of the movement’s parallel government in Afghanistan, have also been captured.

A Taliban spokesman denied the arrests, saying that they were meant to hide the difficulties that United States and NATO forces were having in Afghanistan.

Our favorite Taliban propagandist working for the Asia Times, Syed Saleem Shahzad, tells us that the importance of these high value target (HVT) hits may be exaggerated.

Taliban sources tell Asia Times Online on the condition of anonymity that the appointment will be largely symbolic and primarily for coordination purposes as Taliban leader Mullah Omar, following difficulties in recent years, has decentralized the Taliban’s command structure. The idea is to give commanders in the field greater flexibility and allow for the possibility that should even Mullah Omar be seized or killed, the resistance would continue to function …

“Mansoor’s appointment is very likely, but so far there has been no confirmed decision,” a mid-ranking Taliban official told Asia Times Online. “However, the position of supreme commander is now ceremonial and for the purposes of coordination. In the new setup, military operations have been completely decentralized and are in the hands of local commanders who have been given broad policies. It is up to them to sort out their own tactics,” the Talib said.

“For this reason, Mullah Baradar’s arrest did not have much effect on military operations, including at Marjah [the ongoing major offensive against the Taliban in Helmand province] where the Taliban continue to provide tough resistance to the occupation forces. And whoever is appointed [supreme commander], it won’t make much difference on military operations.”

We’ll see how much operations are affected.  The Taliban have a HVT campaign of their own, so switching sides is problematic.  I have been on the forefront with denials that the HVT campaign is useful enough to justify its effort and expense.  But neither should we deny the usefulness of taking out half of the Taliban Shura.

Either way, it won’t end the insurgency in Afghanistan or Pakistan, and it certainly will not end the globalist intentions of the Tehrik-i-Taliban.  Since different brands of the Taliban swim in the same waters and cross pollinate ideas, something so simple as a HVT campaign won’t end the war in spite of its usefulness.

Lawyers in the Battle Space

Two and a half years ago, I wrote God in the Battle Space.  I cited the example of Lt. Col. Jason Bohm as exemplary of the kind of interaction with the population that engenders trust.  There is another presence in the battle space – that of lawyers.  To be sure, no one intends for there to be any deleterious affects from the presence of law school graduates in the battle space.  But equally as sure, their presence has complicated things.

MARJAH, Afghanistan—As Capt. Anthony Zinni monitored a live video feed from a Predator drone circling overhead, he spotted four men planting a booby trap in the middle of the road here.

For Capt. Zinni, one of the officers responsible for approving airstrikes in the nine-day-old battle for Marjah, it seemed like an easy call: The men were digging a hole alongside a road where a Marine supply convoy was scheduled to pass within hours. But just as he was about to give the order to strike, Capt. Zinni spotted even-smaller white figures on the video running along the path south of the canal.

Children. Maybe 50 feet from the men planting the booby trap. “It’s not a good shot,” Capt. Zinni said, ordering the Predator drone to delay the strike. “It’s not a good shot.”

The 45 minutes that followed help illustrate why it is taking coalition forces so long to secure this hotly contested part of Afghanistan …

When Capt. Zinni spotted the four men planting the booby trap on the afternoon of Feb. 17, the first thing he did was call his lawyer.

“Judge!” he yelled.

Capt. Matthew Andrew, judge advocate for 1st Battalion, 6th Marine Regiment, advises the battalion about when it is legal to order the airstrikes. He examined the figures on the video feed closely. “I think you got it,” Capt. Andrew said, giving the OK for the strike.

Capt. Zinni, 35 years old, grew up among Marines—his father is retired Gen. Anthony C. Zinni, former commander of all U.S. forces in the Middle East—and always seemed destined for the Corps.

The Marines watch almost constant video feeds from unmanned aircraft, including Predators armed with Hellfire missiles and piloted remotely by crews at an Air Force base near Las Vegas. The suspected insurgents were digging on a road that ran along the north bank of a wide canal, part of an elaborate irrigation system built with U.S. aid money in the 1950s.

Knowing that the Marine convoy was due to pass over the spot in a couple of hours added pressure to the decision about whether to strike.

Once Capt. Zinni spotted the children and called off the strike, Capt. Andrew loitered behind the Marines at the monitors, pondering the situation. “We have to separate the insurgents from the people,” he said. “If we just bomb the hell out of everything, we’ll have a hard time doing that.” But the Marjah battlefield was constantly changing, with insurgents and civilians often in close proximity.

“If we can ensure there aren’t any kids around, you have a good shot,” he told Capt. Zinni.

On a cot nearby, Lance Cpl. José Guzman-Berrios, a 19-year-old from Carolina, Puerto Rico, was monitoring chat messages pouring in from the Predator mission commander in Nevada. “Children are out of view 30 meters down the road walking west,” Lance Cpl. Guzman-Berrios read aloud.

Even though the children were out of view, the battalion operations officer, Maj. John Harris, worried they could be hit by the airstrike, erasing whatever goodwill the Marines were accumulating by ousting the Taliban. “The last thing I want to do is kill kids,” he said. “Once it’s confirmed there are no friendlies, it’s approved.”

The children, however, soon walked back into view on the screens, pacing along the path south of the canal.

Capt. Andrew suggested that a show-of-force—a loud, low pass by a helicopter or jet—might scare the men into bolting for the compound, or, at least, interrupt their work. “Or they might go into a field, and we may be able to kill them,” Maj. Harris added.

Capt. Zinni had seen this scenario before in Marjah. Insurgents using women and children for cover as they moved weapons or crossed open spaces into fighting positions in buildings. In this case, the captain was certain that the children were acting—either by their own volition or under coercion—as shields for the men planting the bomb.

The way the Taliban see it, he thought, they’d win either way: The Americans might hold their fire and allow them to plant a bomb unmolested. Or the Americans might kill a few civilians, a propaganda victory for an insurgent force increasingly adept at using the media to spread its message.

“We’re not going to be able to hit this,” Capt. Zinni concluded. He ordered the Predator pilot to keep an eye on the men. Maybe they’d lead the Marines back to their commander’s position. Or maybe they’d make a mistake and leave through an area clear of civilians.

Then came a chat message from the Predator mission commander in Las Vegas: “There are no more civilians in the area. Three people in the road at this time.”

“No children?” Maj. Harris said. “Strike ’em.”

Capt. Alex Ramthun, a 31-year-old Harrier jump-jet pilot in charge of talking to the Predator pilot, passed him the order: “Strike approved, strike approved, strike approved.”

But the children returned. “Two children on the opposite side of the canal, approximately 15 meters,” came the message from Las Vegas.

The pilot aborted the attack run and continued to circle.

“It’s not worth the risk,” agreed Capt. Zinni. “They’re doing this on purpose. Wait for them to go out in a field.”

Capt. Ramthun relayed Capt. Zinni’s decision to the Predator pilot. “Shot is no longer authorized,” he said.

That evening, the scheduled Marine supply convoy rambled down the dirt road. Warned of the booby trap, the vehicles stopped short of the spot where the men were seen digging. The Marines removed a buried triggering device, set to detonate the explosives when a vehicle passed. As is often the case, the Taliban had been working in shifts, with one team responsible for digging the hole and planting the trigger, and another team detailed to bury and connect the homemade explosives.

On Friday, the Marines spotted three men digging on the same road. This time there were no civilians around.

Let’s be specific.  No one wants to see children die.  It might have been the case that had Captain Zinni been free to call in air strikes without the approval of the JAG and staff officers, the call would have been timely enough to have been pulled off without noncombatant casualties.

But what we learn in this example has little to do with the the rules of engagement or the protection of the population.  This is unchanged.  What we learn is that there is an every increasing degree of control over calls made in the battle space.

I have a friend who has a theory, and I believe this theory to be substantially correct.  The value, worth or viability of a document, call, decision or judgment is inversely proportional to the number of signatures on that document, or people agreeing to the action.

We train lower ranking field grade officers to make these decisions, we give them the rules, and we send them into the battle space on our behalf.  They need God at their side to help with moral decision-making.  Lawyers are no replacement for God, and our officers most certainly do not need lawyers second guessing or approving their decisions.

COP Keating: Politics and Warfighting

Spencer Ackerman is conflicted over leaving COP Keating open.  Jim Hanson agrees with the commenter that has Spencer thinking – and supports the notion that a commander should be allowed to amend, caveat and stipulate in order to manage the campaign.  Starting this kerfuffle, Spencer’s commenter says:

McChrystal is well within his rights to make individual exceptions to his overarching ruling of giving up the countryside to protect the population centers — and it seems pretty dumb to give up a known avenue of approach like this rat line, especially when the governor is requesting protection.

Well, maybe.  But there is more to this than meets the eye.  I had known for some time that COP Keating had been left open for political reasons at the request of the Provincial officials.  In fact, the politics gets rather ugly.  Richard Engel tells us:

Around 25,000 votes were cast in Barge Matal, approximately ten for every person in the village.  A cynic might say U.S. forces were called in so Barge Matal would be secure enough for local officials to rig the vote.  I have spoken to cynics within the U.S. military leadership in eastern Afghanistan. They go further than that.  They believe the Afghan government used the military (which brought in the ballots by helicopter) to provide cover for vote rigging and that the Afghan request to secure Barge Matal had deadly consequences for U.S. troops.

But it gets even worse.   Jonathan S. Landay (McClatchy reporter who was with the three Marines and Corpsman who perished in the Kunar Province when they were denied artillery support after being ambushed by Taliban) digs deeper.

Army Gen. Stanley A. McChrystal, the top U.S. commander in Afghanistan, kept a remote U.S. base in the country manned last year at the local governor’s request despite warnings from his field commanders that it should be closed because it was vulnerable and had no tactical or strategic value.

McChrystal’s decision to maintain the outpost at Barg-e Matal prompted the top American commanders in eastern Afghanistan to delay plans to close a second remote U.S. outpost, Combat Outpost Keating, where insurgents killed eight U.S. troops in an assault Oct. 3, a McClatchy investigation has found.

Keeping Barg-e-Matal open also deprived a third isolated base of the officer who would have been its acting commander and left its command to lower-ranking officers whose “ineffective actions” led “directly” to the deaths of five American and eight Afghan soldiers in an ambush Sept. 8, according to a high-level military investigation.

In addition, an unidentified witness told the military investigators that the operations center that failed to provide effective artillery and air cover to the U.S. and Afghan force that was ambushed in the Ganjgal Valley was focused instead on Barg-e Matal.

However, the ambush inquiry and a similar high-level Army probe into the Oct. 3 deaths at COP Keating, the worst single American combat loss in 2009, don’t mention that McChrystal’s decision to keep Barg-e Matal open made the combat outpost and the Ganjgal operation more vulnerable.

Instead, the inquiries hit lower-ranking officers — including two field commanders who’d urged McChrystal for months to close Keating and Barg-e Matal — with administrative penalties.

The two officers, Col. Randy George and Lt. Col. Robert B. Brown, and other U.S. officials had warned repeatedly that the two outposts were worthless and too costly to defend, two American defense officials and a former NATO official told McClatchy.

So via the AR 15-6 process, we are on another head hunt in order to exonerate decisions made at the very top.  Listen carefully to me.  I have previously said that COP Keating did indeed serve a purpose, i.e., to interdict fighters flowing from Pakistan into Afghanistan along this route.  That is what makes this so ugly.

McChrystal has a right to decide, stipulate, caveat, circle back around, and whatever else he wants to do.  His giving up the countryside in favor of population centers is wrongheaded, and I do not now and have never concurred with the idea of population-centric counterinsurgency when applied as an exclusive use doctrine.  Nor do I believe in holding terrain.

But again, listen carefully to me.  What neither McChrystal nor any of his reports has a right to do is leave U.S. warriors in poor terrain, with lack of adequate force protection, in inadequately garrisoned outposts, with poor logistics and little outside assistance.  McChrystal DOES have a right to issue deployment / garrisoning orders.  He DOESN’T have a right to forget or ignore basic military doctrine like force protection – not for interdiction, not for politics, not for any reason, ever.

C. J. Chivers on the Afghan National Army

One of our favorite war correspondents, C. J. Chivers, weighs in on the performance of the ANA in Marjah.

MARJA, Afghanistan — As American Marines and Afghan soldiers have fought their way into this Taliban stronghold, the performance of the Afghan troops has tested a core premise of the American military effort here: in the not-too-distant future, the security of this country can be turned over to indigenous forces created at the cost of American money and blood.

Scenes from this corner of the battlefield, observed over eight days by two New York Times journalists, suggest that the day when the Afghan Army will be well led and able to perform complex operations independently, rather than merely assist American missions, remains far off.

The effort to train the Afghan Army has long been troubled, with soldiers and officers repeatedly falling short. And yet after nearly a decade of American and European mentorship and many billions of dollars of American taxpayer investment, American and Afghan officials have portrayed the Afghan Army as the force out front in this important offensive against the Taliban.

Statements from Kabul have said the Afghan military is planning the missions and leading both the fight and the effort to engage with Afghan civilians caught between the Taliban and the newly arrived troops.

But that assertion conflicts with what is visible in the field. In every engagement between the Taliban and one front-line American Marine unit, the operation has been led in almost every significant sense by American officers and troops. They organized the forces for battle, transported them in American vehicles and helicopters from Western-run bases into Taliban-held ground, and have been the primary fighting force each day.

The Afghan National Army, or A.N.A., has participated. At the squad level it has been a source of effective, if modestly skilled, manpower. Its soldiers have shown courage and a willingness to fight. Afghan soldiers have also proved, as they have for years, to be more proficient than Americans at searching Afghan homes and identifying potential Taliban members — two tasks difficult for outsiders to perform.

By all other important measures, though — from transporting troops, directing them in battle and coordinating fire support to arranging modern communications, logistics, aviation and medical support — the mission in Marja has been a Marine operation conducted in the presence of fledgling Afghan Army units, whose officers and soldiers follow behind the Americans and do what they are told.

That fact raises questions about President Obama’s declared goal of beginning to withdraw American forces in July 2011 and turning over security to the Afghan military and the even more troubled police forces.

There have been ample examples in the offensive of weak Afghan leadership and poor discipline to boot.

In northern Marja, a platoon of Afghan soldiers landed with a reinforced Marine rifle company, Company K, Third Battalion, Sixth Marines, which was inserted by American Army helicopters. The Marine officers and noncommissioned officers here quickly developed a mixed impression of the Afghan platoon, whose soldiers were distributed through their ranks.

After several days, no Marine officer had seen an Afghan use a map or plan a complicated patrol. In another indicator of marginal military readiness, the Afghan platoon had no weapons heavier than a machine gun or a rocket-propelled grenade.

Afghan officers organized no indirect fire support whatsoever in the week of fighting. All supporting fire for Company K — airstrikes, rockets, artillery and mortars — was coordinated by Marines. The Afghans also relied entirely on the American military for battlefield resupply.

Moreover, in multiple firefights in which Times journalists were present, many Afghan soldiers did not aim — they pointed their American-issued M-16 rifles in the rough direction of the incoming small-arms fire and pulled their triggers without putting rifle sights to their eyes. Their rifle muzzles were often elevated several degrees high.

Shouts from the Marines were common. “What you shooting at, Hoss?” one yelled during a long battle on the second day, as an Afghan pulled the trigger repeatedly and nonchalantly at nothing that was visible to anyone else.

Not all of their performance was this poor.

Sgt. Joseph G. Harms, a squad leader in the company’s Third Platoon, spent a week on the western limit of the company’s area, his unit alone with what he described as a competent Afghan contingent. In the immediacy of fighting side by side with Afghans, and often tested by Taliban fighters, he found his Afghan colleagues committed and brave.

“They are a lot better than the Iraqis,” said the sergeant, who served a combat tour in Iraq. “They understand all of our formations, they understand how to move. They know how to flank and they can recognize the bad guys a lot better than we can.”

Capt. Joshua P. Biggers, the Company K commander, said that the Afghan soldiers “could be a force multiplier.”

But both Marines suggested that the Afghan deficiencies were in the leadership ranks. “They haven’t had a chance yet to step out on their own,” Sergeant Harms said. “So they’re still following us.”

Shortfalls in the Afghan junior officer corps were starkly visible at times. On the third day of fighting, when Company K was short of water and food, the company command group walked to the eastern limit of its operations area to supervise two Marine platoons as they seized a bridge, and to arrange fire support. The group was ambushed twice en route, coming under small-arms fire from Taliban fighters hiding on the far side of a canal.

After the bridge was seized, Captain Biggers prepared his group for the walk back. Helicopters had dropped food and water near the bridge. He ordered his Marines and the Afghans to fill their packs with it and carry it to another platoon to the west that was nearly out of supplies.

The Marines loaded up. They would walk across the danger area again, this time laden with all the water and food they could carry. Captain Biggers asked the Afghan platoon commander, Capt. Amanullah, to have his men pack their share. He refused, though his own soldiers to the west were out of food, too.

Captain Biggers told the interpreter to put his position in more clear terms. “Tell him that if he doesn’t carry water and chow, he and his soldiers can’t have any of ours,” he said, his voice rising.

Captain Amanullah at last directed one or two of his soldiers to carry a sleeve of bottled water or a carton of rations — a small concession. The next day, the Afghan soldiers to the west complained that they had no more food and were hungry.

It was not the first time that Captain Amanullah’s sense of entitlement, and indifference toward his troops’ well-being, had manifested itself. The day before the helicopter assault, at Camp Leatherneck, the largest Marine base in Helmand Province, a Marine offered a can of Red Bull energy drink to an Afghan soldier in exchange for one of the patches on the soldier’s uniform.

Captain Amanullah, reclining on his cot, saw the deal struck. After the Afghan soldier had taken possession of his Red Bull, the captain ordered him to hand him the can. The captain opened it and took a long drink, then gave what was left to his lieutenant and sergeants, who each had a sip. The last sergeant handed the empty can back to the soldier, and ordered him to throw it away.

The Marines took the latitude to oust the ANP forces upon initial entry to the town of Aynak in the Helmand Province, and install a better ANP unit they had brought with them.  In the case of the worthless ANA officer in Marjah, no amount of training or retraining will help.  This ANA unit is completely dysfunctional from the top down, and the only solution to its problem is to sack the officer and install a new one – and to do so immediately.  Until they see consequences, they won’t change.

Whether they understand formations or not, if this unit is indicative of the state of the ANA we will be in Afghanistan for a very long time – decades, not years.  They suffer from the same problems we have noted in Concerning the Importance of NCOs (citing From Why Arabs Lose Wars, Norvell B. De Atkine), with entitlement mentalities and very flat organizations that don’t recognize the value of NCOs.  The strength of the U.S. military is, quite literally, the NCOs and enlisted men.
