At Savannah River Site (Dept of Energy) there was a contractor who rebuilt electric motors.
The company was owned by a black, disabled veteran.
I asked why the motor shafts were painted red on a pallet of motors in the warehouse one day.
The guy told me they added that to the specifications on his contract because he did such a poor job rewinding the motors, the warehouse personnel accumulated those motors and sent them to the on-site motor shop to be stripped down and rebuilt before they could use them.
Write a contract to save money by subbing the work out, because the DOE shop on-site was too expensive.
Then, when the contractor did such a poor job, send the motors to the expensive on-site shop anyway.
So pay to ship off-site.
Pay for poor work.
Pay to ship back.
Pay on-site DOE employees more to redo the same thing the contractor got paid to do.
And they COULDNT BREAK HIS CONTRACT!
Because:
Minority owned small business.
Veteran owned small business.
Disabled owned small business.

Not just 8a, but small business set-asides as well. If SBA issues a “certificate of competency” you have to use them, often as a sub so the prime has to deal with it.
These programs are mandated by Congress, so failure to bow down will cause problems. But often it is bureaucrats not wanting to take the heat or doing the extra work required to justify non-compliance.

I had a good thing going as a contractor for the Army Corps of Engineers. They were happy with our work which always came in on time and on budget. The only time I ever asked for an extension or contract modification was if their project manager changed the scope of work. Then, an 8A contractor came along. My company, being a White owned small business, lost the work we had to them. Needless to say, they were absolutely unqualified to do the work my company was doing. When that company got in over their head, they hired us to finish the jobs under them. I made sure my prices were such that they made little to no profit off the deal.
