Virginia Ban On Woods And Backyard Shooting?

Am I reading this right?

SENATE BILL NO. 353

A BILL to amend the Code of Virginia by adding in Article 3 of Chapter 12 of Title 18.2 a section numbered 18.2-511.2, relating to outdoor shooting ranges; prohibited adjacent to residential areas; exceptions; civil penalty.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 3 of Chapter 12 of Title 18.2 a section numbered 18.2-511.2 as follows:

§ 18.2-511.2. Outdoor shooting ranges; prohibited adjacent to residential areas; exceptions; civil penalty.

A. As used in this section, “outdoor shooting range” means any partially enclosed or unenclosed area or facility designed for the use of rifles, shotguns, pistols, silhouettes, skeet, trap, black powder, or any other similar sport shooting.

B. It is unlawful to operate an outdoor shooting range within 500 yards of any property zoned for residential use unless the Range Design Criteria developed by the U.S. Department of Energy, Office of Health, Safety and Security have been met.

C. Any person who violates the provisions of this section is subject to a civil penalty of not less than $1,000 nor more than $100,000 for the initial violation and $5,000 per day for each day of violation thereafter.

By stipulating “any partially enclosed or unenclosed area,” they seem to want to outlaw any backyard or woods shooting, regardless of county or town regulations.  In other words, your “range” doesn’t have to be a formally designated range open for business.  It might be your backyard, as long as you’ve put up a berm or some steel targets.

I guess they really are coming for the Fudd regardless of what he thinks.  Shooting is a perishable skill.

There appears to be no depth to which they will not stoop.

    There’s a House Bill (#567) that proposes to shut down all indoor ranges unless 90% or greater of their users are law enforcement officers.

    What I read in that is, 90% of users. Not users that day, or that week. Users.

    No allowance for repeat LEO visits. An officer who visits the range three times every week counts the same as one who only goes once.

    So if there are 900 LEOs using a range, the range’s total clientele can only include 100 “civilians”. Ever. Until more LEOs come and use it.

    And of course, to prove they are serving 90% LEOs, they’ll need to keep a running list (read: registry) of everyone who has ever used the range.

    There is, of course, an exemption for indoor ranges in buildings “owned or leased by the Commonwealth”, but how many of those are open to the public?

    And it’s so simple. Every Virginia county has their land records online. If you know a certain “person” lives in a county, it’s just a matter of visiting the Circuit Court’s online land records office. Use the search function, and you not only have the exact physical and legal address of that “person,” but a slew of other records as well. And unlike the list drawn up for those Connecticut lawmakers, which included worthless info such as PO Boxes, this one will be extremely comprehensive. All thanks to Virginia county governments, which is nicely ironic.

    Combine that information with what can be found via Google Maps–visual street information and satellite imagery–and users have quite the recon analysis. Include USGS topo maps that show surrounding countryside, including hills, valleys, high points, etc., to make it more than complete. Distance rings from the center point would be the piece de resistance, but it isn’t necessary if a person owns a simple golf rangefinder.

    Combine all of this public information into an online database, make it searchable, and you’ve got a top-shelf and _very_ useful…public relations document. (To thoroughly tweak the Marxists and others, give the database URL a .ru top-level domain code. And if it is easily printable into a PDF, it can make handy paper fliers for posting on nearby fences, telephone poles, and cars, too.)

    It’s the same kind of image analysis done for DoD and other clandestine users prior to…well, it’s not hard to guess. But I think the only correct answer would be “restoring liberty and natural rights.”

    “Shooting range” c/would be interpreted by courts as any hunting area (i.e. a “range area”, where “similar sport shooting” occurs). Hunting is a sport, right?

    Ever see a Deer Silhouette? Ever hunt with Black Powder? Congratulations! You now have a “shooting range”. And … you’ve been Fudded!
