New York Court Holds Stun Gun Ban is Not Unconstitutional, in Contravention of Caetano

Herschel Smith · 30 Mar 2025 · 2 Comments

Dean Weingarten has a good find at Ammoland. Judge Eduardo Ramos, the U.S. District Judge for the Southern District of New York,  has issued an Opinion & Order that a ban on stun guns is constitutional. A New York State law prohibits the private possession of stun guns and tasers; a New York City law prohibits the possession and selling of stun guns. Judge Ramos has ruled these laws do not infringe on rights protected by the Second Amendment of the United States Constitution. Let's briefly…… [read more]

We’re The “Only Ones” Hunting Enough

OL.

An off-duty police officer in Coushatta, Louisiana, and three other men are accused of hunting deer illegally at night from a patrol car on Dec. 5. Wildlife agents issued poaching citations to all four individuals.

According to a press release from the Louisiana Department of Wildlife and Fisheries, game wardens initially responded to the sound of gunshots on the east side of the Red River near Coushatta around 8 p.m. on Sunday. When the agents arrived in the area, they found a vehicle spotlighting deer in an open field on private property.

Upon nearing the vehicle, they realized that it was a patrol unit from the Coushatta Police Department. The agents approached the four men in the vehicle, and identified one of them as Javarrea Pouncy, 28, an officer with Coushatta P.D. who was off duty at the time. The other three individuals were identified as Cederick J. Thomas, 36, of Vivian; Anthony B. Caldwell, 31, of Coushatta; and Adam J. Caldwell, 30, of Natchitoches.

Anthony Caldwell, a convicted felon according to the release, was arrested for being in possession of a firearm and for hunting without a license. He was booked in the local jail later that night.

Adam Caldwell and Pouncy were also cited for hunting without a license. All four men were cited for hunting deer during illegal hours, and for hunting from a moving vehicle.

After searching the patrol car and questioning the four men, wildlife agents found them in possession of two antlered deer—one 8-point and one spike—along with three rifles. They determined that Anthony Caldwell harvested the eight-point while Thomas harvested the spike buck. Both deer and the rifles were seized.

In addition to these citations, the Red River Parish Sheriff’s Office has charged the four individuals with trespassing. The Sheriff’s Office will continue its investigation and may have more charges pending for Pouncy. The local police chief told Shreveport’s KSLA12 News that Pouncy has been put on leave, and that he will likely be suspended until the investigation is complete.

Okay.  Well, let’s see here.  Hunting without a license, hunting after dark, hunting from a moving vehicle, and spotlighting deer, all things I learned not to do when I got my hunting license (and knew it anyway).

Then to boot, he was around a felon in possession of a firearm.

Good grief.  But it will take an “investigation” to clear all of this up.

Muslims And Dogs

BY Herschel Smith
3 years, 8 months ago

I think I’ve conveyed my youngest son’s distaste for how the Iraqis treated dogs.  This news from Iran is related.

Islam hates dogs. The Ayatollah Sistani, a renowned Shi’ite authority, called dogs impure on the order of pigs, blood, unbelievers, etc. Some Shi’te ahadith about dogs:

It is detestable for a Muslim to allow a dog to live in his house. (Al-Kafi, H 12735, ch. 12, h 1)

Whoever keeps a dog, every day one Qirat (a certain unit of measurement) is reduced from the (good) deeds of his owner. (Al-Kafi, H 12736, ch. 12, h 2)

I once asked him (the Imam), ‘Alayhi al-Salam, if we can keep a dog in the house. He (the Imam) said, ‘No, you must not do so.’ (Al-Kafi, H 12737, ch. 12, h 3)

Abu Ja’far, ‘Alayhi al-Salam, has said that ‘Amir al-Mu’minin has said, ‘There is nothing good in dogs except hunting dogs or that which guards cattle.’ (Al-Kafi, H 12738, ch. 12, h 4)

“No Dogs Allowed? Iran Considers Nationwide Ban On ‘Dangerous, Harmful’ Pets,” Radio Farda, November 19, 2021:

Iran’s parliament is floating legislation that would ban most household pets in the name of protecting the country from the dangerous influence of “unclean” animals.

Under the bill on the “protection of public rights against dangerous and harmful animals,” prepared by hard-line conservative lawmakers on November 17, Iranians would be barred from owning, breeding, and transporting dogs, cats, rabbits, and other common pets.

Ayatollah Sistani considers dogs “unclean.”  I consider him unclean.  This is just another reason to detest Iran and all of their ilk.

Multitools for Men

At Men’s Health.

Some are rather oddball and don’t interest me.  The Leatherman Signal Topo looks appealing and complete, but of course is also on the high end of the expense spectrum.

If you have a favorite multi tool, weigh in.

Montana Law Now Forbids State and Local Police from Enforcing Federal Firearm Laws

BY Herschel Smith
3 years, 8 months ago

News from Montana.

Montana Gov. Greg Gianforte is stepping forward to protect the residents of his state from the Biden administration’s assault on the Second Amendment.

On Friday, the Republican signed into law House Bill 258. It will prohibit state and local law enforcement officials from enforcing any federal ban or regulation on firearms, magazines and ammunition. It also prohibits the use of state funds to impose federal bans and regulations of these items.

“Today, I proudly signed Rep. Hinkle’s law prohibiting federal overreach into our Second Amendment-protected rights, including any federal ban on firearms,” Gianforte wrote in a Twitter post. “I will always protect our #2A right to keep and bear arms.”

[ … ]

On Friday, The Associated Press reported that Montana’s legislature has tried to pass similar legislation three times in the last eight years – in 2013, 2015 and 2017. Each bill, however, was vetoed by the state’s former Democratic Gov. Steve Bullock.

In early April, Arizona Gov. Doug Ducey, a Republican, signed a comparable bill called the “Second Amendment Firearm Freedom Act,” into law.

Arizona, Missouri, Montana, and possibly New Hampshire (if the law passes), have all taken such action.  This is becoming a good touchstone for who deserves your support in your own state.  If they won’t pledge to sign a similar bill, tell them you’ll campaign for their opponent.

The SCOTUS Doesn’t Care About Religious Liberty

BY Herschel Smith
3 years, 8 months ago

Pathetic news.

The Supreme Court on Monday permitted a COVID-19 vaccine mandate in New York that doesn’t include a religious exemption, the latest instance in which the nation’s highest court has declined to wade into the issue of vaccination requirements imposed because of the coronavirus pandemic.

New York state imposed the vaccine mandate for health care workers in August. The policy allows for medical exemptions but not those based on religious objections. An earlier religious exemption to the requirement expired last month.

The Supreme Court was considering two emergency challenges to that mandate and decided to allow the law to stand in both of them. In each case, three conservatives – Associate Justices Clarence Thomas, Samuel Alito and Neil Gorsuch – said they would have supported temporarily halting enforcement of the mandate.

“Sometimes dissenting religious beliefs can seem strange and bewildering. In times of crisis, this puzzlement can evolve into fear and anger,” Gorsuch wrote in dissenting from the decision to not block the mandate’s enforcement.

“One can only hope today’s ruling will not be the final chapter in this grim story,” he continued. “Cases like this one may serve as cautionary tales for those who follow. But how many more reminders do we need that ‘the Constitution is not to be obeyed or disobeyed as the circumstances of a particular crisis . . . may suggest’?”

Nurses, doctors and other health care workers asserted in a lawsuit that the lack of a religious exemption violated their First Amendment right to practice religion. The objections centered on the use fetal cells from abortions in the vaccines’ development.

That means Roberts, Barrett and Kavanaugh were opposed to stepping in front of the mandate and stopping it.

Pathetic.

Eternity calls them.  We will all answer for our sins.

Admitting The Truth About The Vaccine

BY Herschel Smith
3 years, 8 months ago

Seen at Vox Day, this article.

Recently, I received news that top researchers at multiple highly respected institutions (including Harvard) who had earlier been publicly promoting the vaccine have now changed their minds and are privately refusing to get the booster.

How is that possible? Did we finally convince them with the data? Most of my truthteller friends have been censored and/or deplatformed. So what is causing these people to shift their views so quickly?

The credit for the attitude shift goes our best convincer: the vaccine itself.

These researchers are seeing first hand how dangerous the vaccine is because they are involved in studies in hospitalized and/or outpatients and they see the numbers first hand.

Of course, they can’t say anything officially since they would be fired or have their funding taken away.

The nurses, NPs and PAs saw it before the doctors did, and openly admitted it all (many of them refusing to take the shot).

The doctors risked the loss of too much money.
